Terms of Use of ABANCA Chat Service
This chat uses Generative Artificial Intelligence technology based on information provided by ABANCA.
You must read these Terms of Use, which will always be available on the ABANCA website.
1. Purpose
The chat service is owned by ABANCA and is intended solely to inform and assist users with any questions related to products and/or services offered by ABANCA, how to navigate, operate, or contract through ABANCA’s website, etc.
Please note that this service is provided through technology that uses artificial intelligence, and therefore the responses provided by the chat may not be up to date or may be incorrect. Accordingly, this information is non-binding.
If you require personalized advice, we recommend that you visit an ABANCA branch or use other channels made available by ABANCA for such purposes, such as telephone services.
The chat service may not be used to access accounts, request or execute transactions, or contract products or services. Any account-specific matters must be handled through secure, authorized channels designated by ABANCA.
ABANCA will never request personal or confidential information through the chat, such as banking or financial information including access credentials, PINs, account numbers, or card numbers. You must refrain from providing such information at all times. You must also not provide any third-party information through the chat. You are expressly prohibited from providing sensitive personal information through the chatbot, including but not limited to Social Security numbers, account credentials, or financial account information.
ABANCA reserves the right not to respond to inquiries that are unrelated to the purpose of the chat service. Communications through the chatbot do not constitute official notices to ABANCA and will not be deemed received by ABANCA for any legal or contractual purpose.
The chatbot provides general information only and does not constitute financial, legal, tax, or investment advice. You should not rely on chatbot responses as a substitute for advice from a qualified professional or authorized ABANCA representative. Any information regarding products or services is subject to applicable terms, conditions, and approval requirements, and does not constitute an offer or commitment by ABANCA.
By using the chatbot, you consent to communicate with ABANCA electronically for purposes of this service.
2. User Obligations
You must use the chat service diligently and properly and must not use the service for activities that are unlawful, contrary to morality, public order, or generally accepted standards of conduct, or that infringe upon the rights and interests of ABANCA or third parties. You must also refrain from any use that could damage, disable, overload, or impair the normal functioning of the Service.
You must not use inappropriate, offensive, defamatory, or abusive language.
You must not provide personal data or confidential information about yourself or third parties through the chat. Conversations will be stored for purposes including analytical, service improvement, security, and compliance.
ABANCA will never request personal data through the chat. For security purposes, such as detecting suspicious activity or maintaining service integrity, the IP address used to access the chat may be associated with the conversation. The processing of IP addresses is for purposes of ensuring the security and integrity of the service and in accordance with applicable law.
If you provide personal data of yourself or third parties to ABANCA, you do so at your own responsibility.
In case of breach of these Terms of Use, ABANCA may automatically terminate the chat without prior notice.
You agree not to use the chatbot in violation of applicable laws, including U.S. export control or sanctions laws.
3. Limitation of Liability
ABANCA does not guarantee that access to or use of the chat service will be uninterrupted or error-free. ABANCA shall not be liable for damages arising from improper use of the Service, nor for outages, interruptions, or defects in telecommunications. The user is solely responsible for having an appropriate internet connection. The chat service may be unavailable or interrupted at any time. To the fullest extent permitted by applicable law, ABANCA disclaims liability for any damages arising from the use of the chatbot.
ABANCA shall not be responsible for how you use this service, and the user agrees to hold ABANCA harmless from any claims, whether judicial or extrajudicial, arising from the user’s use of the service.
ABANCA shall not be liable for damages of any kind arising from the information provided in chat responses, nor for damages resulting from confidential information or data provided through the chat.
ABANCA shall not be liable for damages arising from the impersonation of a third party by the user in communications through the Service.
Information provided by the chat service shall not be considered advice, recommendation, or a determining factor in decision-making, and ABANCA disclaims any liability for its use in that regard.
Chatbot responses are generated automatically and may be incomplete, inaccurate, or outdated. In the event of any discrepancy, information provided through official ABANCA channels or by authorized representatives shall prevail. Use of the chatbot does not create a customer, advisory, or fiduciary relationship between you and ABANCA.
4. Intellectual and Industrial Property
The chat service is exclusively owned by ABANCA and is protected by intellectual and industrial property laws. It may not be exploited, reproduced, distributed, modified, assigned, publicly communicated, or otherwise used without ABANCA’s express authorization.
Access to the Service does not grant the user any ownership or rights over ABANCA’s intellectual or industrial property, other than the right to use the service.
5. Modification and Termination of the Service
ABANCA reserves the right to modify these Terms of Use, in whole or in part, and to add new conditions. The current terms will always be available on the website.
ABANCA may modify or discontinue the chat service at any time, particularly in the event of technical or operational difficulties affecting security.
ABANCA may temporarily suspend access to the chat service for maintenance, updates, improvements, or any other reason it deems appropriate.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida and applicable federal laws of the United States, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.
